Petitioner affirms, under oath and subject to the penalties of perjury, that, to the best of hisknowledge, there are no criminal investigations or charges pending against him in any jurisdiction. 5. Petitioner acknowledges and understands that Indiana Code § 35-38-9-9(i) allows only onepetition for expungement. Petitioner certifies that he made a good faith effort to remember andobtain records for all his convictions. Petitioner has no knowledge of any Putnam Countyconvictions other than the convictions set forth in this Petition. 6. Petitioner filed, or will file, petitions under Indiana Code § 35-38-9 in the following counties: Clay County 7. Petitioner served a copy of this Petition on the Putnam County Prosecutor.Class D/Level 6 Felonies that Did Not Result in Bodily Injury. Count 1 (Cause No. 67D01-1702-F6-23) 8. Kyle Lee, a law enforcement officer of the Greencastle Police Department, arrestedPetitioner on or about February 6, 2016. 9. The State of Indiana filed criminal charges on February 7, 2016, under case number 67D01-1702-F6-23. 10. The State of Indiana charged Petitioner with: A. Count 1 - Possession of Methamphetamine (L6). B. Count 2 - Possession of Marijuana (A-Misd.). C. Count 3 - Possession of Paraphernalia (C-Misd.). 11. Petitioner was convicted of the following charges on January 24, 2018: A. Count 1 - Possession of Methamphetamine (L6). 12. The State of Indiana dismissed the remaining counts and charges. 13. Petitioner is not prohibited from seeking this remedy under Indiana Code § 35-38-9-3(b). 14. Fewer than eight (8) years elapsed between Petitioner’s conviction and this Petition. ThePutnam County Prosecutor provided written consent for any early expungement and Petitioner fileda copy of the consent with this Petition. 15. Petitioner affirms that, to the best of his knowledge, he has not committed another crime inany jurisdiction within the shorter period set forth above. 16. Petitioner paid all fines, fees, and court costs, and no restitution obligation was imposed aspart of the sentence. 17. The case that Petitioner is requesting be sealed has not been appealed. 18. Petitioner received services or treatment from the following providers under court order inconnection with this conviction: A. Putnam County Adult Probation; B. WHEREFORE, Petitioner Dylan Alexander Romandine respectfully requests that the Courtgrant this Petition and: 20. As to Count 1, order the expungement of Petitioner’s conviction records under IndianaCode § 35-38-9-6, specifically: A. The following agencies and entitles shall be prohibited from releasing Petitioner’s records or information in Petitioner’s records to anyone without a court order, other than a law enforcement officer acting in the officer’s official duty; i. The Indiana Department of Corrections; ii. The Indiana Bureau of Motor Vehicles; iii. Each law enforcement agency who incarcerated, provided treatment for, or provided other services for the person under an order of the court; and iv. Each person or entity who incarcerated, provided treatment for, or provided other services for the Petitioner under an order of the court. B. The Indiana State Police Central Repository for Criminal History Information shall seal all records related to Petitioner’s expunged convictions, including but not limited to convictions in this cause, counts that were dismissed in this cause, counts where there was a finding of not guilty in this cause and any reference to an arrest in this cause, and is prohibited from disclosing the records to anyone except those persons or entities specifically enumerated in Indiana Code § 35-38-9-6(a)(2): i. A prosecuting attorney, if: a. Authorized by a court order; and b. Needed to carry out the official duties of the prosecuting attorney. ii. A defense attorney, if: a. Authorized by a court order; and b. Needed to carry out the professional duties of the defense attorney. iii. A probation department, if: a. Authorized by a court order; and b. Necessary to prepare a presentence report. iv. The Federal Bureau of Investigation or the Department of Homeland Security, if disclosure is required to comply with an agreement relating to the sharing of criminal history information. v. The: a. Supreme Court; b. Members of the State Board of Law Examiners; c. Executive Director of the State Board of Law Examiners; and d. Employees of the State Board of Law Examiners, in accordance with the rules adopted by the State Board of Law Examiners; for determining whether an applicant possesses the necessary good moral character for admission to the bard. vi. A person required to access expunged records to comply with the Secure and Fair Enforcement for Mortgage Licensing Act (12 U.S.C. § 5101 et seq.) or regulations adopted pursuant to the Secure and Fair Enforcement for Mortgage Licensing Act. vii. The Bureau of Motor Vehicles, the Federal Motor Carrier Administration, and the Commercial Driver’s License Information System (CDLIS), if disclosure is required to comply with Indiana Code § 9-23-6-2(d) relating to reporting a conviction for a violation of a traffic control law.C. The Clerk of the Indiana Supreme Court shall be notified to seal any records in the Clerk’s possession that relate to the conviction in a manner consistent with Indiana Code § 35-38-9-6(d): i. Redact the opinion or memorandum decision as it appears on the computer gateway administered by the office of technology so that it does not include the Petitioner’s name (in the same manner that opinions involving juveniles are redacted); and ii. Provide a redacted copy of the opinion to any publisher or organization to whom the opinion or memorandum decision is provided after the date of the order of expungement. D. Except as provided in Indiana Code § 25-38-9-6(c) and (d), the records of the sentencing court, a juvenile court, the Court of Appeals of Indiana, and the Indiana Supreme Court concerning Petitioner shall be permanently sealed. 21.
